The Constitution left the matter of abortion to the states, for whatever reason. Its silence on the question no more binds a state to a particular view of the matter than its silence on other questions. Given the high incidence of miscarriage and mortality in child birth, for all we know, counting the born in the census was merely pragmatic, in order to get a more stable figure, and did not reflect a philosophical position at all........
