InterDigital/Samsung: Resolves License Pact Dispute

KING OF PRUSSIA, Pa. -(Dow Jones)- InterDigital Communications Corp. (NasdaqNM:IDCC - News) will record an additional $500,000 in fourth-quarter revenue related to an arbitration decision involving Samsung Electronics Co. and licensing.

The arbitration decision by the International Chamber of Commerce, International Court of Arbitration resolved a dispute between the companies related to the manner in which InterDigital's patent license agreement with Nokia Corp. (NOK) should apply to Samsung's most favored licensee rights.

In a press release Thursday, wireless technology provider InterDigital said Samsung's prior royalty credit of $18.7 million will decline to $6.7 million to account for royalties due on sales of licensed code-division multiple access products through Dec. 31, 2001.

The dispute dealt with specific contractual terms in the Samsung patent license agreement and did not involve any issue of validity or infringement of ITC's patents. Samsung's royalty obligations for sales of 2G and 2.5G TDMA wireless communications products commencing Jan. 1, 2002, will be determined in accordance with the terms of the Nokia patent license agreement.

The decision of the arbitration panel is binding, subject to limited appeal rights.

In November, InterDigital expressed optimism that its 2002 revenue will increase by about 40%. The guidance implies revenue of $73.6 million based on the $52.6 million generated a year ago.

In the fourth quarter of 2001, revenue was $8.4 million.
