That is his excuse for calling it irrational. Why wouldn't a terrorist apply for a visa; in fact, a lot of the 9/11 terrorist had valid visas. Whiie a rational terrorist wouldn't apply for a visa on the basis of being a terrorist, there are other reasons to require a valid visa.

"The mass arrests have further eroded confidence in the fairness of the INS and the immigration system among Arab and Muslim communities," said the lawsuit. It was filed by the American-Arab Anti-Discrimination Committee, the Alliance of Iranian Americans, the Council on American-Islamic Relations and the National Council of Pakistani Americans.

Fine by me. I can only wish that they all go back home and get the treatment they feel they deserve from Saddam and the clerics.
