That is not correct. The US immigration laws don't give citizens a private right of action, so you can't sue your employer or prospective employer for violation of the immigration laws. The Department of Labor and Justice could sue an employer for defrauding the H1-B program or bring criminal charges. You might be able to back-door a lawsuit by bringing it as a violation of your civil rights, but I've never heard of that succeeding. And I doubt it would because you would have to show invidious discrimination against you as a citizen, which is not a protected class. You might also try to whistle-blow on your employer, and then you could stand in the place of the DOL/Justice in a qui tam suit, but then you couldn't prove money defrauded from the US government. Nothing to recover. JMO.
