My last job in the Bay Area was for a company that placed a lot of H-1B contractors at Cisco. I just heard that Cisco will no longer take any people from them and this will probably kill the H1-B shop. I personally know of one former co-worker who successfully sued for a $100K settlement with my former employer because he was a US citizen and they laid him off and replaced him with a H1-B which is illegal.

Wow! I had *no idea* that it was illegal to lay off a US citizen and replace them with an H1-B.

I have a theory about some of the H1-B reverse discrimination against Americans though. I think once a foreign worker gets into some sort of management position in one of these big IT shops - as is the case with Applied Materials for example- they start discriminating in their new hires and only take others from their same country of origin. An american worker would never do this... we have *diversity* and *affirmative action* engrained in our psyche. But foreign workers have no such sense. You would think the upper management at Applied would sense something was amiss with an Oracle IT department composed solely of H1-Bs from Bangalore. After all Oracle is an american company from down the street. But Applied management chooses to look the other way, they don't want to bother with this - they have enough trouble with their in-house IT staffing and systems anyway.

H1-Bs are going away now for sure... of course outsourcing is cropping up but thats fine with me, imo the high cost of maintenance and DBA expertise and other systems support was getting so high it was hindering the companies trying to sell software. Right now there is a sense this outsourcing is going to take all jobs away but I don't believe it, I think the tactical management and hands on tech lead stuff stays here close to the user community.

Actually, I'm surprised you mention Cisco in your post. I always felt Cisco preferred an american workforce over foreign, they have a lot of "technofunc" positions there where everyone is supposed to have some business savvy in thier approach to problem solving. Seems like all the american contractors I knew wound up at Cisco (and these people were more expensive than people from tata).
