After the lawyers from all over the world get their 2-cents worth in as to what kind of prisoners or detainees they are Geneva Convention is very clear on that. unhchr.ch Should any doubt arise as to whether persons, having committed a belligerent act and having fallen into the hands of the enemy, belong to any of the categories enumerated in Article 4, such persons shall enjoy the protection of the present Convention until such time as their status has been determined by a competent tribunal. There is clearly doubt as to their POW status. Now, where is the "competent tribunal"? And why are the prisoners whose status is in doubt NOT "enjoying the protection of the present Convention until such time as their status has been determined by a competent tribunal"?
