Jim, it's quite likely that QCOM not only saw the handwriting on the wall but entered into an agreement with MSFT on Wireless Knowledge mainly to dissuade MSFT from competing directly with QCOM as it introduced its CDMA services. Incidentally, the level of evidence that Sendo needs in order to prevail against MSFT is less than the standard of "beyond a reasonable doubt" that is used in criminal actions. Even if Sendo is successful, however, the action will take years to complete, and perhaps in the meantime Sendo will have to file for bankruptcy.

All this litigation and the deals that led to it makes me recall the words of Warren Buffett: "You cannot make a good deal with a bad person."
