I find that hard to believe. Still, I am no lawyer and so I asked the question to a lawyer friend. I will post his response soon.

Seriously though - Do you really believe it was the intention of the Geneva convention that the capturers should decide between a couple of officers on the ground that the people they capture are not POWs? Even if you believe this, can you think of one good reason why the US would NOT have said "We had a competent tribunal and the decision is that they are not POWs"? Because, you know, they didn't declare anything of the sort.
