Murder does not apply to a fetus as it is not considered a person. Therefore, the killing of a fetus is outside the reach of that legal principle.

Perhaps you consider the fetus to be a person, but this would be your principle: not that of society at large--and certainly not common to the educated community.

Out of curiosity, do you also consider the fertilized egg to be a person and capable of being murdered...or violated in other ways for which it would have just claim for compensation? I would naturally be puzzled if you considered the fetus any more of a person than what it was the day before that and the day before that, and so forth back to the mostly invisible egg.
