Harlan you also "got it" on all counts EXCEPT court tampering. 1st Amendments, Free Speech, protects us all on opinions. People can give their opinion that the patent is good or not. When the facts (not opinion) are false or in "reckless disregard of the truth" and are published to others in any medium, the author and publisher are liable for defamation. Liable for damages (actual) and punative (in an amount to deter future defamations of such nature).

One would need to know:
1. What was false
2. What a reasonable investigation for the truth would have unvailed
What the truth really is
3. And were the "(mis)statements of fact stated in reckless disregard of the truth
4. Were the shareholders of GIFT damaged
5. Should punative damages be awarded given the evidence.

That was Defamation 1.01, the case of E-Data vs McGraw-Hill.
