A recount isn't a violation of the US constitution. A recount targeted to certain counties might (and the the opinion of the USSC does). A better argument (which the supreme court did not make) is that the constitution requires that the elections procedures follow the rules set out by the legislature and FL law demanded that the results be in by a certain date and allowed for the FL Secratary of State to certify them.

In any case Gore opened the whole can of worms of having the election decided in the courts by fileing suit in the first place. Other candidates, including Nixon in his run against Kennedy, could have tried to have the decision changed by the courts but did not.
