The basis is from the ruling:

Its holding that the accused has no right even to respond to the allegations against him applies only when someone "has been designated an enemy combatant and it is undisputed that he was captured in a zone of active combat operations abroad" -- presumably, a small category. But the principle is dangerous nonetheless, and it could serve as a beachhead for broader presidential powers of military detention.

How is this precedent abusable? It is too narrow for me to see how it holds any real danger.......
