If we assume the facts where along the lines of your hypothetical I would not have to personally be in the court room to reach a conclusion that he was racist.

And neither would anyone else in America. The problem is there is a great deal of evidence to suggest Pickering is NOT a racist, but the Democrats on the committee picked isolated incidents that make great TV sound bites on which to lynch this guy.

Again, Schumer did make it clear what the REAL basis was: Ideology. In his statement he made no bones about it; the time was right to give the Committee approval authority of the appointee's ideology. Orin Hatch was quick to point out to Schumer that Republicans may give them a dose of it back at a future date. The Democrats on the committee have tried to override the Constitution by giving themselves (a limited body consisting of the likes of Schumer, H. Clinton, Feinstein, etc.) veto power over presidential appointments.
