Everybody is "possibly" innocent, capital crime or not.

That's correct.

Using "possibly" as a standard, no conviction holds up.

Since when did the conversation go from being about the death penalty to a discussion of the burden of proof in criminal convictions in general? Try to keep up, okay?

And the deterrent effect is proved every day.

OK, what's the proof?

Couldn't I as easily and convincingly say that, with every murder that takes place everyday in this country, claims of deterrence are scuttled?
