If they are innocent then the death penalty may or may have not have deterred them, depending on whether or not they were motivated to murder someone and the precise reason why they did not, or were prevented from doing so. If they are guilty then nothing deterred them or they would not be guilty of murder because they would have been deterred from such an act.

However, there is no doubt that killing them will prevent them from murder whether or not they were the guilty one. However, if they were innocent then the true murderer would likely only be further emboldened to kill, and would suffer no deterrence from another being executed in his stead.
