If the death penalty is valid, it is tolerable that there be mistakes in its application. It is known that some number of people will die through vehicular mishaps in the course of a year, but we do not ban automobiles. It is known that a very small number of people will die of vaccination, but we continue to vaccinate, even making it mandatory. An activity is not considered illegitimate just because there are risks of (innocent) deaths attached, as long as the individual risk is considered trivial, say, on the order of magnitude of 1/1000, or thereabouts. Thus, one need not assert perfect administration, one need only be confident that all procedural safeguards yield a high confidence of rightful conviction......
