unless we are willing to give 17 year olds all of the rights of an adult, I am unwilling to judge them as adults in situations that essentially take their lives away. I believe that it is important that the state apply the same rules and conditions across the board. If the state says "sorry, you aren't mature enough to drink alcohol or vote or smoke a cigarette", then the state doesn't get to change the rules midstream and say "well, you are a special case, even though we didn't grant you the right to smoke, vote or drink, we are going to retroactively deem you mature enough to be judged as an adult". Consistent application of the criteria that determines adulthood has to be meaningful to the "unusual" part of cruel and unusual thing. And if the state can't make that determination up front, there is no reason that we should allow them to make it on the back end.
