I never tried to argue that. I've tried to argue that there are no absolutes when it comes to the subject of the DP no matter how you slice and dice it.

I never said pre-emption was bad. That's the war thread. ;-) I just want everyone to get the terminology right and call a spade a spade. Imprisonment is pre-emption. I have nothing against imprisonment for murderers.

Because deterrence does not work in every case is not an argument against deterrence. Seatbelts don't work every time, would you ban seatbelts. Stoplights are sometimes ignored, would you ban stoplights.

Let's stop dancing and around with stats, what ifs and "logical extrapolations." I'm not against deterrence. I'm against using the DP as a deterrent.

Are you saying that the logical but conscienceless person will ignore the logical conclusion that committing murder might lead to execution? I don't see how lacking a conscience would lead a logical person to abandon logic. It would seem that the desire for self-preservation in your mind depends on having a conscience. I doubt that that is true.

Well, that's the angle I was trying to take before, but then you came back with this:

Lack of conscience in no way bars logical thought. One who murders is obviously somewhat deficient in conscience but may be acting in a very logical way. The loan shark who kills a delinquent borrower to encourage other "clients" to pay up is being logical.

Doesn't matter how you look at it. Your loan shark guy wasn't deterred by the DP. ;-)
