Compare drunk driving with secondhand smoke. If we don't let individuals threaten the health of others in airplanes, public places, etc, but they are free to smoke themselves to death at home, then restricting intoxicated driving is no different. There is no law against private intoxication as long as you don't decide to use your family as a punching bag in the process.

Fortunately, smoking or not smoking is an easy offense to determine, unlike specific blood alcohol levels.
