Most likely the guy who owns the company (my husband is just one of a dozen foremen), if it could be proved he conspired to help them commit fraud then the INS would press charges. If someone presents you with a green card, a social security number and fills out the proper IRS employment forms....has a US employment history, this is the best you can do. It's not like my husband's company actively seeks to hire people with false documents, I was just being realistic in thinking that there are most likely some in the mix.

It's difficult for any employer to know for sure who they are hiring. I've heard more then one story about people hiring someone with another person's identity and work history. In the construction industry where people are hired on for piece work or to beef up crews temporarily for a crunch, you can imagine they don't interview for weeks. There are times if you show up on a site with your tools and they need someone, they will hire you on the spot. They'll make you pee into a cup, but they don't do extensive background checks. They have a continual shortage of workers and it's been this way for the company my husband works for as long as I can remember. They haven't had a recession. It ticks me off to hear the local politicos go on about how there aren't any good paying jobs for (insert whatever victim class you want) when he continually has to hire anyone who will show up for work on time.

The only way you could be assured that you didn't hire any illegals was if you avoided hiring anyone with an accent or who looked foreign. Then you open yourself up to a discrimination suit. I've had people come to me for a job at my company that spoke very American English and you couldn't tell they weren't from the US. I'm sure there are more than a few employers who don't know they have hired someone who is illegal (as well as plenty who don't care).
