That form of argument -- if you make something illegal people will do it anyhow and will do it less safely so the only answer is to make (or keep) it legal -- is simply invalid and unworthy of intelligent discourse.

Chris, I haven't made that argument. I thought you had been paying attention.

The closest I have come to that argument is observing that making abortions illegal won't stop abortions. Perhaps it wouldn't even make a bit dent in them. I don't know about you, but I think that the efficacy of a proposal is "worthy of intelligent discourse."

Back to the point of the post to which you responded, if you don't mind. It would be interesting to see what states would do with the laws they already have on their books were Roe v. Wade to be overturned. Probably most would no longer like those old laws and prefer something somewhat different but they might be difficult to change, the status quo being the default and all that. As we were discussing earlier, you don't often hear proposals to send women to jail anymore. So what would Arizona do, send the women to jail or only enforce that portion of the law that was in keeping with current thinking? It would be interesting to observe the states trying to figure out what to do with the laws already on their books.
