The comparison is specious.

It is a fact that each state has varying degrees of urban, immigrant and racial makeup that correlate closely to murder rate. Places like Vermont, Maine and North Dakota have large white rural populations interspersed among mountains, and are not prone to crime in general, let alone murder. OTOH, places like Maryland, Illinois and Alabama have the demographic makeup the correlates to a high murder rate.

If one were to conduct a fair analysis, comparing neighboring states with almost identical demographics would be more appropriate. North Dakota (with no death penalty) has a higher murder rate than South Dakota (with the DP). Michigan (no DP) is higher than Ohio (DP).

Moreover, an even better analysis can be done with by measuring the drop in murder rate by states which recently adopt the DP. New York's murder rate dropped 52% in the first two years of DP re-enactment, and 70% in total since. Kansas has also dropped significantly since re-enactment.

And don't forget executions. Can't murder again if you're dead!
