"1/3 of this rate comes from non DP states"

WHY??

1/2 of remaining rate (3.3) is unaffected (crimes of passion, insanity, negligent homicide {i.e. drunk driving, reckless driving, etc.}

WHY??

"That leaves 3.3 or 3.4 homicides left that are deterrable by DP"

You are inventing meaningless numbers and saying absolutely nothing.

"Suppose 10% of potential premeditated murderers are deterred by the DP"

WHY?? Let us suppose 0% as that is what the evidence indicates. Why make up figures unless you have no genuine concern for the truth of the matter?

"But this is what one might expect given the small increase in deterrence the DP adds (if my thought experiment has any validity"

No. Your "thought experiment" had no validity because it was based on fabrication rather than fact.

"Any idea that the DP causes the difference in rate between the two groups is a stretch at best."

Correct. The DP appears to have nothing to do with the rates of homicide.

"It remains certain that if the DP does deter even one potential murderer, a virtual certainty IMO, to forgo the DP is to sacrifice the innocent victim of that murderer"

The DP does not deter murder. But executing an innocent definitely kills an innocent, and possibly several more in that the guilty party is free to kill again.

"I did not backpedal"

Well, no. You just rode yourself right over the cliff edge! LOL! Imagine having the gall to come to me with the argument that you are going to prove that the DP is a deterrent by simply stating that 10% of potential murderers are deterred!! You really expose yourself!! And 1/3 of a homicide rate would not come from non DP States. You have already been told that DP States have almost double the homicide rate as non DP States.

And even if they were equal (as you so falsely assumed)!...the non DP States are approx. 1/4 of the States--NOT 1/3!! Not that that matters in the slightest bit, either! The POPULATION of the DP versus non DP was the only thing that counted. Yeah...Alaska and New York on a one to one contribution ratio! Christ, you are a piece of work!

And then after all that nonsense you simply state that you will supply the figure of 10% deterrence of potential premeditated murders because it seems like a good idea to you and thus proves that 10% of premeditated murders are deterred! LOL!! My suggestion to you is to find something you are good at--because it sure in the Hell isn't thinking!
