Let's try this again:

Suppose a state passed a law saying that murders committed om Mondays, Wednesdays, Fridays, and Sundays would get the death penalty and the other days would get life w/o parole.

Which days of the week do you think would have the most murders?


Tuesdays, Thursdays and Saturdays.

But the death penalty has no deterrent effect?

Of course it has a deterrent effect!! As does LIPWP (life in prison without parole)! I don't know which is the better deterrent of the two. Maybe that depends on one's religious beliefs.

So if the DP does not have a greater deterrent effect than LIPWP, why would most choose to murder on the days when they would get LIPWP?

Religion? It's wrong any time. And you go to Hell either way. The only argument left is that choosing LIPWP delays that. And that's exactly the deterrent effect intended.
Because, taking that one step further, if you don't murder, you may not go to Hell at all.
