That's what judges are supposed to do. In particular, it is up to the judge to insure that sentences fit the crime. I think Pickering has shown in innumerable cases that he used the same care in sentencing whites as well as blacks. If he were racist, he would not have done so -- he would NOT have gone the extra mile to insure that sentences of convicted blacks were lightened when appropriate.

There's a lot more to Pickering than was disclosed in thos Nat. Review articles that were posted. Judge Pickering violated an important judicial law when he tried to help up Mr. Swan. He made what is considered an ex parte contact while the trial was ongoing. Its an issue that was not introduced in the Nat. Review articles written by Byron York. When confronted with that violation, Pickering made light of it, suggesting he had a lapse of judgement. Brit Hume of FOX also made light of the issue. However, Senator Edwards considers it to be a little more serious than that.

Below is a link to a site put up by Edward that provides commentary from three different legal experts on the 1994 Daniel Swanson case. There is agreement among these three that Pickering acted very inappropriately for a judge. Their remarks are disturbing and further put in doubt Pickering's qualifications to be a federal judge.
