A re-read of the pricing announcement states one thing very clearly.
"The Canadian launch of the company's lead product, PENNSAID". Not "if or when approved" but that "is" what proceeds "will" be used for.

TORONTO, Jan. 23 /CNW/ - Specialty pharmaceutical company, Dimethaid Research Inc. (TSX: DMX) is pleased to announce that it has priced its shareholder rights offering...

Proceeds will be used for general corporate purposes, including the Canadian launch of the company's lead product, PENNSAID(R), as well as for capital expenditures and development of new products based on the company's proprietary technology platforms.

...I conclude that since Dec 2, when DMX rec'd HC's approvable letter, that negotiations re labelling have progressed to the point where DMX has in hand, an acceptable labelling proposal, subject to DMX's execution of the paperwork. There may be some minor modifications and signatures on DMX's part but I believe DMX is finally at the stage where they control the outcome and can and have stated in the rights pricing PR that PENNSAID will be launched in Canada. And the rights proceeds have been earmarked for that specific purpose. Anything short of that would in my opinion be an outright lie.
