His position towards racial measures is checkered at best. I don't think someone who's position wavers based on his biases will make a good judge.

That just sounds like a more veiled way of saying he is racist. There is nothing solid to say he is racist so you look at the smoke and see that it is not clear that he is obviously not racist. But its not clear that anyone is obviously not racist. People could be hiding thoughts and motivations. I believe in innocent to proven guilty. Since this is not a court of law and he isn't facing criminal penalties I would not insist on proof beyond all reasonable doubt but I think it should be solidly established.
