His position towards racial measures is checkered at best. I don't think someone who's position wavers based on his biases will make a good judge.

That just sounds like a more veiled way of saying he is racist. There is nothing solid to say he is racist so you look at the smoke and see that it is not clear that he is obviously not racist. But its not clear that anyone is obviously not racist. People could be hiding thoughts and motivations. I believe in innocent to proven guilty.


That's exactly my point......there is enough there to insure clarity; and when there is doubt, one should not move forward.

Since this is not a court of law and he isn't facing criminal penalties I would not insist on proof beyond all reasonable doubt but I think it should be solidly established.

Pickering is being hired for a job.......a position as judge. I don't know about you but I try to get the best person possible for a job. If there are questions, and they can't be answered, I go to the next candidate. This approach is very common in hiring.
