Pikering is facing a political process. He is being smeared because the democrats want to avoid conservative judges. If there were solid questions about him in this area he would have little chance of being nominated and no chance for confirmation. But some of the democrats in congress or in certain special interest groups will find something, real or not, to smear any conservative with unless he has almost no record, in which case they will attack him for being inexperienced.

Then, apparently, smearing a Conservative is not that hard to do. I haven't looked into the qualifications of many GOP nominees but if Pickering is considered a very good one, then I would consider raising the bar. They did with Lott.
