That is certainly true, but I've never heard of a criminal lawyer trying a patent lawsuit. Most attorneys who handle patent litigation tend to specialize in Intellectual Property (patents, copyrights, antitrust, tradesecret and trademarks) litigation. Also, claim interpretation is a very technical issue that requires the judge to decide (as a matter of law) what was meant by the technical language of the claims. Attorneys for the parties in our case are patent litigators. I imagine none of them would feel competent to take a criminal case.

I like the British system better where "special" judges who have patent law and technical expertise hear patent cases.

I realize this has little to do with the thread, but nothing much seems to be happening with GIFT, so I'll spout off while we wait.
