A fine is imposed because of culpability, not merely action. If someone commits homicide, but it is justifiable, than he is off the hook. If someone commits homicide, but did not plan it, he is charged with manslaughter, a lesser charge. Thus, it makes perfectly good sense to suppose that someone would not be fined unless he violated an actual rule without excuse, or unless he were guilty of an ethical lapse.

Refuted? I have continually pointed out that you are putting words in my mouth, and you persist in doing so, and it is on that basis that I say you are full of it. Stop mischaracterizing what I have said.......
