Is the circumstantial evidence presented by Powell of such a character and are the circumstantial facts so related to each other that the only conclusion that can be fairly drawn is that Iraq still possesses weapons of mass destruction? This is the test which the court would use in civil litigation when a party seeks to prove their case by circumstantial evidence. Has Powell satisifed this test?
