Neither can newborns think for themselves.
That's what makes birth a good point for the legal definition. It is early enough that that conciousness has not occurred and it is a very well defined event that it hard to mistake or fake.

When you focus upon thought, you focus upon an arbitrary human attribute.
That is the feature that sets humans apart from the rest of life on the planet.
