if on this basis you can kill unborn kids, you can use the same basis to kill unwanted newborns since both unwanted newborns and unwanted unborn kids exist. The main problem with infanticide is that it does not have a clear enough event to make a good basis for law. Birth is a definite event that is hard to fake, either the baby is born or the fetus is still in the mother. There are some advantages to placing a time period since I don't think anyone should be forced to raise an extremely premature infant just because some zealous hospital workers wanted to try out their latest technique.
