You offer the example of an accused rapist for comparison to the situation with Saddam H. and that he should be considered innocent until proven guilty and thus be afforded all the rights we normally give accused people.
Well, I can't frame the situation with Saddam as him being court room defendant with rights. While you say it makes no difference today that he gassed 5,000 (maybe more) of his own people, I say it does have a bearing because it is proof he has no qualms using WMD. I believe he still has those chemical/biological weapons and he is not disarming.

And so I think the best strategy is to use a big stick for now and hope Saddam H. retires to Lybia with immunity and if he doesn't retire or disarm immediately then we go to war with Iraq. The region is inflamed, Saddam is exactly the same as Milosevic. With Saddam's ouster the world stands a better chance at peace. I doubt the Iraqi people will put up much of a fight, in fact, they'll likely be joyous to see their despot murdering dictator end his raping and pillaging of that country.
