Update: INRE: Taubman sucks

"OK, technically, it's not "officially" over until the judge says it's over, which hasn't happened yet. But just a few days after our victory in the Court of Appeals, Taubman's attorney contacted my attorney and said that they wanted to dismiss the case. We concurred with their motion to dismiss the case "with prejudice" (which, as I understand it, means that they can't turn around and refile the lawsuit), and they submitted the motion to the judge, where it awaits his signature.

If you visit the TaubmanSucks website, you'll notice that I haven't yet added a last "act" to document the dismissal of the case. That's because I'm not going to write that last act until I can post a dismissal order that bears the judge's signature. But I thought that I should go ahead and notify you folks because many of you (especially those of you here in the Dallas area) may be reading about it in the newspaper -- tomorrow's Dallas Observer (which actually hit the streets today) includes a two-page article about the case, and the article mentions the dismissal. I haven't actually seen it in print yet, but I've read the story online. And so can you:

dallasobserver.com

Since so many of you have been so helpful to me for so long, I thought that I should send you this note so you'd hear the good news directly from me instead of having to read about in the newspaper.

To say that I appreciate all of the support I've received from those of you who are reading this would be a massive understatement. It seems that every time Taubman did something to knock the wind out of my sails, every time I started to feel that I was in this thing *way* over my head, I'd get an email from a total stranger thanking me for not giving in and exhorting me to keep fighting the good fight. And in addition to the massive support, many of you (including several attorneys) offered me invaluable practical advice -- in fact, one of you steered me to Paul Levy, the Public Citizen attorney who was responsible for the resounding victory in the Court of Appeals a couple of weeks ago. I am profoundly grateful to all of you who helped me get through this.

Anyway, even though it looks like the case is over, I may still post new material to the TaubmanSucks site from time to time, which means that I may also mail out these updates every once in a while. I recognize that many of you already receive far more email than you can handle -- and with the dismissal, some of you may not wish to receive these notes in the future. If that's the case, please don't hesitate to ask me to remove you from my email list, you won't hurt my feelings. (Well, maybe just a little -- but it's been an exceptionally pleasant couple of weeks, I'm pretty sure that I can handle the rejection.)

Again, thank you all so much for all of your help and support. Quite literally, I couldn't have done it without you.
