As those who have studied the matter are aware, you are correct about JnJ's early efforts with DMSO. As you may (or may not) know there are actually two patents, the second being a CIP (Continuation-In-Part) of the first patent. However, there is a Terminal Disclaimer on the first patent.
In my opinion, there is no patent on DMSO based delivery systems possible,...it is in the public domain.
Most universities have a patent person who could give you an opinion on this matter. Look them up. The Pennsaid delivery system is patentable,...it is three ingredients plus the NSAID and water. I can think of several ingredients that could serve as replacements for the ingredients other than DMSO and water, I my bet is DMX could not stop them from being commercialized with the current patent,...nobody could. J&J can probably think of many more.
