WRT "there is precedent", I dont buy that line.

The practice of law is based on precedents that have stood the test of time.

As for ICJ - you may have noticed that its mandate has nothing to do with crimes against humanity and crimes of war:

The Court has a dual role: to settle in accordance with international law the legal disputes submitted to it by States, and to give advisory opinions on legal questions referred to it by duly authorized international organs and agencies.


As I said, the International Criminal Court had a good potential of being the sort of international body you would like to see handle cases like Sharon's, before the US axed it because it could not garner immunity for its citizens. I agree that it would have been better that way, but when it is impossible to establish such courts because a major force doesn't want to play on level ground, well, I am all in favor of local courts taking up such cases.
