You argue from a tautology, you insist that law is more accurate because it is more lasting.

Dear me, I do no such thing (I don't think you understand what a tautology is technically). Please remember you are attempting to pinion Neocon into a position wherein he must easily accept radical change to the Constitution. You are trying to do this because Neocon apparently is willing to ignore Washington's casual advice to America not to enter into treaties. Your position is essentially exemplified in the question "if you can ignore Washington, why can't you ignore the Constitution?"

It is a deeply flawed position and obviously so.

Washington ain't the Constitution. He was no king that he could bind the whole nation by mere edict. His advice has built-in flexibility because of this. It may have been very applicable at the time, but not now, and we are able to ignore it because he was no king.

Not so the Constitution. The very purpose of that document is to codify into law a certain essential way of life that existed in 1787 and then bind all Americans to it for perpetuity.
