You're entirely correct. I understand that. Circumstanial evidence certainly has its place in the trial process. And can be and has been used to rightfully convict guilty parties millions of times. But, just the word circumstantial carries a meaning of uncertainty. For example, I would be very weary of sentancing someone to death based upon circumstanial evidence, because of the uncertainty surrounding the evidence. Many convicted people on death row have been exonerated. It's well over 100 at this point since capital punishment was reinistitued back in 1976.
