I was responding to your post (made in response to David's comment about judicial activism) that said -

" Yes. If you don't go forward, you go backwards. Granted our founding fathers knew a thing or seven about government, but wouldn't it make sense that certain laws and philosophies that made sense in the 18th century might not do so in the 21st?"


My point was that judges shouldn't change laws or the constitution. If regular laws need to be changed the state legislatures or congress can do it, and if the constitution needs to be changed it should be amended rather then changed by fiat by a judge who thinks he should "go forward".
