There was another free speech issue that involved a mall a few years ago. The judge in that case ruled that malls have taken the place of the public square and ruled against the mall.

I know. That was a peace protest during the Gulf War in 1991, here in New Jersey. In any case, you contradicted your first point. Malls aren't exclusively private property like a private resturaunt. There is no hostess at the mall who can tell you that you are violating the dress code when you enter. The courts have ruled that malls are the equivalent of public squares. If malls are going to have a dress code, they'd have to ban tee-shirts all together or ones with offensive language on them. I doubt a PEACE tee-shirt would qualify as offensive language. It's private property. But, why are they harassing someone who is just sitting there eating lunch with a peace tee shirt on? That's a simple free speech issue in my eyes. The guy has a right to go to a mall with a peace tee-shirt on, sit down and eat lunch, without being harassed, as long as he isn't bothering anyone. I want to live in a country where I have the right to do exactly that.
