It was an arrest for trespassing. The owner didn't want the people there any more, told them to leave and they would not. Its not really a free speech issue. You don't have a right to come in someone elses property and then refuse to leave when they want you to go.

I think the argument can be made legally that a mall [outside its shops] is public space even though its owned by a private person.

And I agree with you, the Patriot Act worries me too.
