E-Data stands the most to lose from protracted litigation.

The reason is simple. A patent has a clock attached to it and is thus a "wasting asset" (similar to options). Plus one lawyer isn't going to cut it in the face of any serious challenge. One of the things lawyers love to do is "review the prior art" and produce something like 50K pages worth of technical material which must be slogged through and picked apart. All while the meter ticks to the tune of several hundred dollars per hour per lawyer.

The alternative to this is for E-Data to grant a license for peanuts. Not a pleasant choice.
