ESS Tech Seeks Injunction Or Expedited Trial

FREMONT, Calif. (Dow Jones)--ESS Technology Inc. filed a motion for a preliminary injunction, or alternatively an expedited trial, in its copyright- infringement lawsuit against Taiwanese chip designer MediaTek Inc. .

In a press release Wednesday, the digital entertainment technology company said that the motion filed in the U.S. District Court for the Northern District of California alleges that MediaTek unlawfully copied proprietary DVD firmware and user interface in its products.

ESS asked the court to stop MediaTek's products and DVD players containing those products from being imported into the U.S. and to recall all infringing products from distributors, retailers and end users.

Alternatively, the motion requests an expedited trial that would make the injunction permanent if ESS wins its suit.

A MediaTek representative wasn't immediately available for comment.

ESS filed the suit against MediaTek in September. At the time, ESS alleged that MediaTek used its copyrighted DVD firmware for its Swan and Vibratto products. MediaTek denied the charges.
