As opposed to France's announcement that they would veto ANY AND ALL resolutions authorizing use of force in Iraq??


(1) You should be able to think on something without trying to find someone else who has done some wrong to make your side look less wrong, thereby avoiding to consider the issue at hand.

(2) France said they would veto all resolutions with a clause for automatic war trigger, without a UN Sec Council authorisation. I believe they were correct in insisting on this, because it was all too clear that US/UK would just pick an excuse, forge a document, or something and attack, then argue "But this and that was breached".

Will they be able to prosecute him after he leaves office?

What do you mean "will they be able to"? Does France look like a dictatorship to you? (Maybe US/UK armies should stop by over here, invade, and do a quick "regime change" thing on their way back from Iraq? :-)

To answer your question - Yes. The only way Chirac escaped was being elected. He is automatically going on trial after his term. TotalFina is not the only case they have against him, by the way.
