If a state can incarcerate your for 50 years and still be libertarian then I don't see why a state can't kill you and still be libertarian. I would think that its more an issue of what gets the death penalty, or other severe penalty or any penalty at all. If the state controls very little, but does give the death penalty for murder it would seem to be an example of a minimalist state that in no way contradicts the tenents of libertarianism. Even if it is somehow seen as a violation of those tenents, I can't see how it rises to some special absolute standard that is more against libertarian thought then any other government action. We might have to just agree to disagree on this. Anyone else have an opinion on the subject? Tim
