Isn’t a self fulfilling prophecy? As the month progresses, the number of puts and calls written/traded migrates to the current stock price (gotta be in the money or near in the money to make any). Unless there is a big unfilled gap one way or the other, we’ll always be near max pain, especially on an index vehicle like the QQQ.
