Obviously ole 49r doesn't choose to answer the question "..were you aware that 'mikesloan' is Merrick Walsh"? And that's her prerogative.

It's clear, though, that it is important at this stage to learn about "who knows who, or knew what, when." It's all fine to talk about taking personal responsibility for investment decisions if the playing field is marked out and the game isn't rigged. When information is honestly put forward people have an opportunity to regard it or disregard such data in making decisions to buy or sell shares.

It's a whole other ball game if you have company touts, including relatives, who are spreading disinformation and falsely posing as average investors. And in the case of Merrick Walsh, by privately telling people he's David Walsh's brother that (at least in the pre-bust days) lent credibility to his claims in their eyes -- giving them reason to support his positions to other investors.

There are numerous legal precedents that have established in such circumstances that responsibility certainly does adhere to the touts. Company officials, brokers, unregistered investment advisors, promoters etc. have all been found legally responsible in cases where investors have been misled.

When the game is rigged, it's no longer speculation or even gambling. It's fraudulent. In such circumstances it's hardly fair to blame the victims.

If ole 49r was aware that mikesloan is Merrick Walsh it alters the context of her comments posted here -- past any point at which she became aware. It's one thing to spread false information in a mistaken belief that it's true, it's an entirely different matter if you have knowledge of something like that and fail to disclose it.

Had it been made clear on SI that drumbeat/mikesloan was Merrick Walsh his posts would have been viewed in an entirely different light. People would have been free to accept or reject his advice -- in the knowledge of the source. But to falsely represent something, well it sounds more like what Bre-X officials did in connection with the orebody...
