This is an apples and oranges discussion re terrorism. It depends on which legal box you put terrorists in: Criminals-handled by criminal justice system, soldiers- which you keep detained in POW camps, or war criminals -who you detain and try with military tribunal. As to Israel and US for that matter, WE are at War. So you kill your enemy whereever they are-no arrest/trial etc.Israel certainly is at War as only ceasefires existed in the past which have been broken. It is a different kind of war but war nevertheless and Israel uses War means and methods as do the Palestinians. So the rules of War apply and premptive strikes against your enemy are the norm. Same with our War on Terror. Premptive strikes are the norm. The terrorists have openly declared war on us numerous times by words, and video tapes and attacked us and indicated they will again using WNMD, so the US is now at war and attacking wherever are intelligence tells us to per Bushes last speech on board the Carrier. We are using different means and weapons depending on the situation and enemy. I am sure Syria is getting this message right now. But if you choose the criminal box instead, everything changes including our civil rights versus security. In wartime security concerns must be balanced against civil rights and you have less civil rights. If just a criminal process is involved then civil rights are inviolate to protect our dignity and reliability of evidence. Choose your box. Many thoughtful people think we should treat it as a criminal justice matter and not WAR. But the President and Congress have voted otherwise.
